Data Use and Protection Policy

What Data and Why We Collect It

We collect the following data and information to provide PITCH’s Services, as well as improve the experience of our Services for our users:

Your Personal Information. When you sign up for your PITCH account, we collect data about you and your projects, such as your name, phone number, email address, role, occupation, and/or details about your abilities that you wish to provide (“Your Personal Information”). Some of our Services let you connect your accounts and import your information from other service providers. If we ask for sensitive personal information, such as your gender, race, nationality or sexual orientation, providing this information will be completely optional and voluntary, and will be used only if you opt to include it on your public profile or in connection with your projects (for instance if you want it to be visible to producers who are seeking a diverse writer or filmmaker).

Your Project Information. Our Services are dedicated to making it easy for you to store and view your project files, project descriptions, scripts, screenplays, development materials, media, narrative works, documents, evaluations, scores, and so on (“Your Project Information”), as well as optionally share some of your Project Information with industry professionals. To make that possible, we store, process, and transmit Your Project Information, and data related to it.

Your Usage information. We collect data related to the ways you use the Services, such as actions you take in your account (like updating, editing, sharing, messaging). We use this data and information to improve our Services, develop new features, protect PITCH users, and provide value to our users.

Device information. We may also collect information from and about the different devices you use when you access the Services. This information may include the browser type, IP addresses, the referral website or web page you visited before visiting our websites, and unique identifiers associated with your devices. Your devices (depending on the device settings) may also send location information to the Services.

Cookies and customer data tracking technologies. We may use technologies like pixel tags and cookies to improve, provide, and promote our Services or the security of our Services for all users. You can adjust your browser settings to not accept cookies, however this could limit your ability to use the Services.

Payment information. For convenience, when purchases are made through PITCH, we may save a tokenized reference to your credit card information on Stripe, or another authorized third-party secure credit card processing service. PITCH uses industry standard encryption technology to protect credit card and password information but because the website and services incorporate third-party payment services, we cannot be responsible for the handling of credit card and/or other payment data as it relates to the use of said third-party payment service providers. Additionally, because no security system is impenetrable, we cannot guarantee the security of our databases, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet or via wireless providers’ networks. Nevertheless, PITCH will never share this ycredit card information or charge any customer without their explicit consent, except as may be required by law or court order.

Marketing and Third Party Promotions. We offer users the option to use some of our Services free of charge. These free Services may include optional free hosting for Your Project Information in PITCH’s industry-facing database (should you choose to do this). If you register for our free Services, we may, from time to time, send you information and promotions about upgrades when available, or relevant promotions from third parties. Any user who receives this promotion can opt out of the email list at any time. If you do not want to receive marketing materials from us, you can simply click the ‘unsubscribe’ link at the bottom of any email from us or update your preferences in your PITCH account settings.

PITCH is a data “controller,” meaning we determine how to use and process the data of our users who create PITCH accounts, and PITCH is also a data “processor,” meaning we process personal data on behalf of PITCH’s partner organizations (for example, contests, festivals, and fellowships that manage their submissions using the PITCH software).

Reasons for processing your data. We collect and use the information described above so that we can provide you with our Services in a reliable, secure, and useful manner in accordance with generally accepted best practices, on a lawful basis and in compliance with the EU’s GDPR (General Data Protection Regulation) and other applicable regulations. To the extent that we may process Your Personal Information for other purposes, we will ask for your consent beforehand or require that our partners obtain such consent explicitly from you.

With Whom Your Information May Be Shared

We may share some data about you, but we won’t sell your data to third parties or advertisers.

PITCH uses some trusted third parties (for example, providers of data storage, IT services and customer support) to help us improve, provide, protect, and promote the Services. These trusted third parties will access your data and information to perform tasks only on our behalf in compliance with our Privacy Policy, and we remain responsible for the handling of your information. Our trusted third parties that may process your information on our behalf and in order to provide our Services include, without limitation, the following services, and this list may be updated from time to time: Amazon Web Services, Stripe, Google Drive, Gmail, MailChimp, Zapier, Twilio, Zoom, and Microsoft. Additionally, organizations’ script readers and judges may use third party software and devices to display and read PITCH submissions as well as Your Profile Information. PITCH may also disclose Your Personal Information when required by law or court order.

Our Services may display information such as your name, profile information, project title, logline, description, and messaging to other users in places like your user profile and email notifications. You can also share Your Project Information with other users if you choose. When you submit your project to a third-party contest, festival or service which uses PITCH as a submissions management platform, Your Project Information may be updated, amended, and imported into your PITCH account per your agreement with the third-party contest or service to which you submitted your project. This helps you sync all of your project information and data in one place, which is part of PITCH’s Services to its users.
